The charge  of sexual assault is covered by section 271 of the Criminal Code of Canada. It involves the punishments if an indictable offence an imprisonment of not more than 10 years, and if the complainant is under 16 years of age then imprisonment of not more than 14 years and minimum punishment of one year imprisonment. For an offence punishable on summary conviction. Imprisonment not more than 18 months, or of the complainant is less the 16 years of age; to imprisonment not more than two years less a day and to a minimum punishment of imprisonment for a term of six months.

Sexual offences such as sexual assault and other related charges can seriously damage the lives of individuals and their families.  This charge carries a damaging and negative stigma greater than most other criminal allegations.  This can be defined as an assault with a sexual nature, that is carried out against another person, without their consent.  In the Canadian Justice System this is considered a very serious crime.  However, there are a number of available defences that can be utilized, depending on the various details of the case.  One of the central issues is consent.
